- An advanced contract award notice (ACAN) is a public notice indicating to the supplier community that a department or agency intends to award a contract for goods, services or construction to a pre-identified supplier, thereby allowing other suppliers to signal their interest in bidding, by submitting a statement of capabilities. If no supplier submits a statement of capabilities that meets the requirements set out in the ACAN, on or before the closing date and time stated in the ACAN, the contracting officer may then proceed with the award to the pre-identified supplier. 1. Definition of the requirement: Policy on Reciprocal Procurement: the Policy on Reciprocal Procurement does not apply to this procurement. The Correctional Service Canada has a requirement for safety in the community via facilitating culturally sensitive interventions in support of Indigenous offenders in Newfoundland and Labrador. The work will involve the following: 1.1 Objectives: To provide traditional teachings and guidance to Inuit offenders in the St. John’s, NL area primarily to those residing at the St. John’s Community Correctional Centre and the John Howard Halfway House in St. John’s, NL. This will ensure that all Inuit offenders on parole in the St. John’s area are being offered traditional Inuit cultural teachings and ceremonies as required. This will allow Inuit offenders to gain a deeper understanding of their cultural values, beliefs and background and reconnect with the Inuit ways. 1.2 Tasks: The Contractor must provide Inuit Cultural Support on as requested basis. The Contractor must provide services in person at the St. John’s Community Correctional Centre or the John Howard Society Halfway House in St. John’s, Newfoundland. The Contract must provide services over the phone to Inuit offenders residing in the institutions with the potential of in-reach face to face meetings with Inuit offenders and CSC staff across Atlantic Canada. The Contractor must provide all materials required for Inuit Cultural Support. The Contractor must, as a participant to the National Elders Working Group (NEWG), advise the Director General, Indigenous Initiatives Directorate on spiritual, traditional and cultural protocols and practices as well as provide recommendations on policy, procedures and interventions impacting Indigenous offenders. 1.3 Expected results: The Contractor must provide up to a maximum of 465 hours per year of traditional teachings and guidance to Inuit offenders in the St. John’s, NL area primarily to those residing at the St. John’s Community Correctional Centre and the John Howard Halfway House in St. John’s, NL. 1.4 Deliverables: 1.4.1 The Contractor must provide written details of all the services provided with each invoice. The Contractor must provide updates to the ICLO (Indigenous Community Liaison Officer) or the RHQ Project Officer with IID on the outcomes for the sessions provided to Inuit offenders. This must include identifying the location where and how (in person or by telephone) the Contractor provided services to offenders. 1.4.2 Paper consumption: a. Should printed material be required, double sided printing in black and white format is the default unless otherwise specified by the Project Authority. b. The Contractor must ensure printed material is on paper with a minimum recycled content of 30% and/or certified as originating from a sustainably managed forest. c. The Contractor must recycle unneeded printed documents (in accordance with Security Requirements). 1.5 Constraints: 1.5.1 Location of work: a. The Contractor must perform the work at: St. John’s Community Correctional Centre 86 Charter Avenue St. John’s NL A1A 1P7 or John Howard Halfway House 7 Garrison Hill St. John’s, NL A1C 3Y7 Other CSC correctional facilities in the Atlantic Region. b. Travel i. Travel will be required for performance of the work under this contract. 1.5.2 Language of Work: The contractor must perform all work in English or Inuktitut language. 1.5.3 Institutional Access Requirements Contractor personnel will be escorted at all times by Correctional Service Canada personnel or those authorized by CSC on its behalf. Contractor personnel must adhere to institutional requirements for the conduct of searches by Correctional Service Canada prior to admittance to the institution/site. Correctional Service Canada reserves the right to deny access to any institution/site or part thereof by any Contractor personnel, at any time. 2. Criteria for assessment of the statement of capabilities (minimum essential requirements): Any interested supplier must demonstrate by way of a statement of capabilities that it meets the following requirements: The supplier must be recognized by their community as an Elder/Cultural Advisor within that community. Experience: The supplier must have a minimum of five (5) years of experience obtained in the past 10 years prior to the ACAN closing date in delivering spiritual and cultural services and teachings to Indigenous people. This experience must include: ? providing counselling and guidance according to the traditions and teachings of their own community; and ? being familiar with and able to conduct a variety of ceremonies with a focus on healing according to their own teachings. The supplier must be familiar with and able to provide guidance to staff and offenders regarding the protocols surrounding the use, disposition, and searching of traditional medicines and spiritual effects. The supplier must meet with a circle of Elders already under contract with CSC where they will be able to share their experiences and where the Elders will be able to determine the validity of the statement of capabilities. CSC reserves the right, at its own discretion, to request that supplier provide a reference letter and/or resume, in addition to their statement of capabilities, to support the knowledge and experience claimed. 3. Applicability of the trade agreement(s) to the procurement This procurement is not subject to any trade agreement. 4. Set-aside under the Procurement Strategy for Indigenous Business This procurement is set-aside for an Indigenous Supplier in accordance with the government Procurement Strategy for Indigenous Business (PSIB). Therefore, only suppliers who meet the definition of an Indigenous business, as defined in the PSIB, may submit a statement of capabilities. This restriction does not apply to contracts with individuals who are Elders. 5. Comprehensive Land Claims Agreement(s) This procurement is not subject to a Comprehensive Land Claims Agreement. 6. Justification for the Pre-Identified Supplier There is a limited number of suppliers available to provide culturally sensitive interventions to meet the reintegration needs of CSC Indigenous offenders on parole. The pre-identified supplier meets all of the minimum essential requirements described in this ACAN. 7. Government Contracts Regulations Exception(s) The following exception to the Government Contracts Regulations is invoked for this procurement under subsection: (d) only one person is capable of performing the contract. 8. Exclusions and/or Limited Tendering Reasons This procurement is not subject to any trade agreement. 9. Ownership of Intellectual Property There are no intellectual property terms in the contract. 10. Period of the proposed contract or delivery date The proposed contract is for a period of one (1) year, from May 1st, 2026 to April 30th, 2027 with an option to extend the contract for two (2) additional one-year periods. 11. Cost estimate of the proposed contract The estimated value of the contract, including option(s), is $110,175.30 (GST/HST extra). 12. Définition des besoins Politique sur l’Approvisionnement réciproque : La politique sur l’approvisionnement réciproque ne s’applique pas à cet approvisionnement. Le Service correctionnel du Canada (SCC) a un besoin lié à la sécurité dans la collectivité en facilitant des interventions culturellement adaptées à l’appui des délinquants autochtones à Terre Neuve et Labrador. Le travail comportera les éléments suivants : 1.1 Objectifs Fournir des enseignements traditionnels et des conseils aux délinquants Inuits dans la région de St. John’s (T.-N.-L.), principalement à ceux qui résident au Centre correctionnel communautaire de St. John’s et à la maison de transition John Howard de St. John’s (T.-N.-L.). Cela permettra de s’assurer que tous les délinquants Inuits en liberté sous condition dans la région de St. John’s se voient offrir, au besoin, des enseignements et des cérémonies traditionnels Inuits. Cette mesure aidera les délinquants Inuits à approfondir leur compréhension de leurs valeurs, croyances et origines culturelles, et à se reconnecter avec l’héritage Inuit. 1.2 Tâches L’entrepreneur doit fournir un soutien culturel Inuit sur demande. Les services seront offerts en personne au Centre correctionnel communautaire de St. John’s ou à la maison de transition de la John Howard Society à St. John’s. L’entrepreneur doit fournir des services par téléphone aux délinquants Inuits résidant dans les établissements, avec la possibilité de rencontres en personne (in reach) avec les délinquants Inuits et le personnel du SCC partout dans la région de l’Atlantique. L’entrepreneur doit fournir tout le matériel nécessaire pour le soutien culturel Inuit. L’entrepreneur doit, en tant que membre du Groupe de travail national des Aînés (GTNA), conseiller le directeur général de la Direction des initiatives autochtones sur les protocoles et pratiques spirituels, traditionnels et culturels, ainsi que formuler des recommandations concernant les politiques, les procédures et les interventions ayant une incidence sur les délinquants autochtones. 1.3 Résultats prévus L’entrepreneur doit fournir jusqu’à un maximum de 465 heures par année d’enseignements et de conseils traditionnels aux délinquants Inuits dans la région de St. John’s (T.-N.-L.), principalement à ceux qui résident au Centre correctionnel communautaire de St. John’s et à la maison de transition John Howard de St. John’s (T.-N.-L.). 1.4 Produits livrables 1.4.1 L’entrepreneur doit fournir des détails écrits sur tous les services fournis avec chaque facture. L’entrepreneur doit fournir à l’ALAC (agent de liaison autochtone dans la collectivité) ou à l’agent de projet de l’AR de la DIA des mises à jour concernant les résultats des séances offertes aux délinquants Inuits. Celles ci doivent préciser l’endroit où les services ont été fournis ainsi que la manière dont ils l’ont été (en personne ou par téléphone). 1.4.2 Utilisation de papier a. Si du matériel imprimé est requis, l’impression recto verso en noir et blanc doit être utilisée par défaut, à moins d’indication contraire du responsable du projet. b. L’entrepreneur doit s’assurer que, pour le matériel imprimé, on a recours à du papier ayant un contenu en matières recyclées d’au moins 30 % ou ayant été certifié comme provenant d’une forêt gérée de façon durable. c. L’entrepreneur doit recycler les documents imprimés qui ne sont pas nécessaires (en conformité avec les exigences relatives à la sécurité). 1.5 Contraintes 1.5.1 Emplacement des travaux a. L’entrepreneur doit effectuer les travaux à : Centre correctionnel communautaire de St. John’s 86, avenue Charter St. John’s, TNL A1A 1P7 ou Maison de transition John Howard 7, Garrison Hill St. John’s, TNL A1C 3Y7 Autres établissements correctionnels du SCC dans la région de l’Atlantique. b. Déplacements i. Des déplacements seront requis pour l’exécution des travaux dans le cadre de ce contrat. 1.5.2 Langue de travail L’entrepreneur doit effectuer tous les travaux en anglais ou dans la langue Inuktitut. 1.5.3 Exigences d'accès institutionnel Le personnel de l'entrepreneur sera accompagné en tout temps par des membres du personnel du Service correctionnel du Canada ou des personnes autorisées par ce dernier à agir en son nom. Le personnel de l'entrepreneur doit respecter les exigences de l’établissement en ce qui a trait aux fouilles par le Service correctionnel du Canada avant d’être admis dans l’établissement ou l’unité opérationnelle. Le Service correctionnel du Canada se réserve le droit d'interdire à tout moment l'accès à un établissement ou unité opérationnelle ou une partie de ceux-ci au personnel de l’entrepreneur. 2. Critères d'évaluation de l'énoncé des capacités (exigences essentielles minimales) Tout fournisseur intéressé doit démontrer au moyen d’un énoncé des capacités qu’il satisfait aux exigences suivantes : Le fournisseur doit être reconnu comme un Aîné ou un conseiller culturel au sein de sa collectivité. Expérience : Le fournisseur doit avoir au moins cinq (5) années d’expérience dans la prestation de services et d’enseignements spirituels et culturels aux Autochtones acquises au cours des dix (10) années avant la date de clôture de ce PAC. Cette expérience doit comprendre : ? fournir des services de counseling et d’orientation conformes aux traditions et enseignements de sa collectivité; et ? doit bien connaître et être apte à diriger diverses cérémonies axées sur la guérison conformes à ses enseignements. Le fournisseur doit avoir l’habitude et la capacité de conseiller les employés et les délinquants sur les protocoles qui régissent l’utilisation, l’élimination et les fouilles d’objets spirituels et de médecine traditionnelle. Le fournisseur doit rencontrer un cercle d’Aînés déjà à contrat avec le SCC, au sein duquel il pourra partager ses expériences, et où ces derniers pourront établir la validité de l’énoncé des capacités. Le SCC se réserve le droit, à sa seule et entière discrétion, de demander au fournisseur de soumettre, en plus de leur énoncé de capacités, une lettre de référence et(ou) un curriculum vitae qui justifient les connaissances et l’expérience alléguées. 3. Applicabilité des accords commerciaux à l’achat Le présent approvisionnement n’est assujetti à aucun accord sur le commerce. 4. Marché réservé en vertu de la Stratégie d’approvisionnement auprès des entreprises autochtones Ce marché est réservé aux fournisseurs autochtones conformément à la Stratégie d'approvisionnement auprès des entreprises autochtones (SAEA) du gouvernement. Par conséquent, seuls les fournisseurs qui satisfont à la définition d’« entreprise autochtone », telle que définie dans la SAEA, peuvent soumettre un énoncé des capacités. Cette restriction ne s’applique pas aux marchés avec des particuliers qui sont des aînés. 5. Entente(s) sur les revendications territoriales globales Cet achat n’est pas assujetti à une entente sur les revendications territoriales globales. 6. Justification du recours à un fournisseur sélectionné à l’avance Il existe un nombre limité de fournisseurs en mesure d’offrir des interventions culturellement adaptées pour répondre aux besoins de réinsertion des délinquants autochtones du SCC en liberté conditionnelle. Le fournisseur sélectionné à l’avance rencontre toutes les exigences essentielles minimales décrites dans ce PAC. 7.
